Mediation Solutions Dispute Resolution Processes

Adjudication, mediation, negotiation, and struggle are all mechanisms for resolving and settling disputes or "dealing with opposing preferences".

Mediation is the most popular form of dispute resolution. Many remarkable results are achieved through this non adversarial process thus saving time, considerable expense and relationships. It is commonplace to hear Mediators claiming higher than 75% success rates in areas of dispute from marriage separation through to employment disputes, neighbourhood disputes, disputes between family and friends to environmental and commercial issues. The Courts are increasingly referring litigants to Mediation in order to resolve their differences; such as - separating couples, fathers/mothers seeking access and/or maintenance orders, workplace and organisational disputes etc. Some recent press coverage involving high profile litigants have on the suggestion of the Judge postponed legal proceedings to engage in Mediation, resulting in positive outcomes thus saving time and money.

Research undertaken by Kelly and Gigy 1989 - reported findings on the reasons given by mediation clients for choosing mediation. Four reasons identified by more than 80% of male and female clients are to (a) reach an agreement that is satisfactory to all parties (93%) (b)reduce or avoid hostility between parties (83%) (c) reduce the cost of obtaining a lawyer (82%) and (d) reduce involvement with lawyers and court proceedings (81%).

Compared with other approaches/processes, negotiation and mediation are more constructive in two senses; positively they contribute more toward reaching mutually satisfactory, durable out-comes, and they generate greater mutual satisfaction with the process itself.
